I. Conditions of Carriage

I.I Conditions of carriage for Citybus Georgia Departures.

These General Terms & Conditions apply for trip or trip segment operated by  Citybus Georgia LLC, or it’s subcontractors’ services, marketed as “Citybus Georgia”
 

 1.

You must be aged 18 years or older to purchase tickets and services from this website.

2.
When booking your journey, you must check your journey itinerary before confirming the payment. No refunds will be given for incorrect or duplicated tickets. The tickets cannot be changed. Once completed, citybus.ge reservations cannot be cancelled or refunded less than 24 hours before departure. There is fee for ticket return if it is more than 24 hours before departure depending on time left. While we will make every effort to operate our services, when a departure has been cancelled due to our negligence or fault, we offer full refund of the ticket price or an alternate travel arrangement.

3.
You should arrive at your departure stop 15 minutes before the scheduled departure of the bus. This will allow you plenty of time to board and we can prevent any delays to the service.

4.
a) Every passenger, including children of all ages, must hold a valid ticket which guarantees a seat on board.
b) A child cannot travel sitting on an adult’s lap. Parents may bring their own car safety seat for the child with them. We do not provide safety seats for children. Children must wear a seat belt during the journey
c) Due to operational reasons we might use buses other than the one planned for the route, and we may not be able to offer the booked seats. In these cases, we do not compensate the lack of specific seats.  
d) We do offer discounted tickets for children up to 12 years old. Customer is responsible to select and buy ticket according to appropriate age category

5.

a) Children under the age of 12 can travel with Citybus Georgia  when accompanied by a person over the age of 15.
b) Children between the ages of 12 – 14 can travel independently if they have a signed letter of consent from a parent or a guardian with them. The consent must be in written format.
d) Children aged 15 and older can travel independently.
e) We do not exercise or provide any care over children traveling independently. Parents or statutory guardians are fully liable for actions of children.

We charge 1€ booking fee for administrative purposes per each payment transaction made with some but not all international ticket distribution systems. One payment transaction may include several tickets. For citybus.ge there is no booking fee charge.

7.
In every Citybus Georgia bus there is one place in each bus where a wheelchair can be securely transported. Request for the wheelchair seating should be made latest 36h in advance by calling service number +995 706 777 925 or via email booking@citybus.ge  In case there are not enough available seats to accommodate the wheelchair at the time of request, we are not able to offer the service.
Wheelchair passenger may be accompanied by an assistant free of charge. Accompanied assistant should be mentioned at the time of booking request as well as the type of the chair used (manual or electric).
The wheelchair, when transportation is confirmed by Citybus Georgia , will be secured and lashed in the area reserved for baggage. In case the lashing cannot be done properly with all required straps due to measurements of the wheelchair, we will be forced to deny boarding of the wheelchair due to inadequate safety. In such a case Citybus Georgia  will, refund the ticket price.

Collapsible walking aids and manual wheelchairs under 20 kg can be transported in the luggage hold free of charge. We do not accept scooter or moped type mobility devices as wheelchairs. Those cannot be transported on our buses.

8.
For tickets bought from citybus.ge, a valid booking reference number acts as the ticket for your journey and you must present this reference or QR code to the driver before boarding the bus. Name information is not used when boarding the bus. Ticket is valid between the bus stops mentioned in the confirmation. Please retain your booking confirmation for the entire journey. If you bought your tickets via international distribution system, you should present printed or mobile  ticket or, in some cases, Citybus Georgia may issue own tickets based on that booking and send you carrier ticket by e-mail. In this case please print or screen shot QR code form ticket to present during boarding.

We offer connecting journeys only on journeys found online in our web portal that include a planned connection. For some of the journeys arriving in border crossings with connecting bus operators we have also taken into account the connection between buses from both sides of border.

10.

Passenger should always reserve enough time for the change of buses when they buy a connection between separate routes. If our departures are delayed or cancelled due to circumstances beyond our control, we will not reimburse any loss of a connecting journey in cases where the customer misses their connection.

11.

When traveling to an airport a minimum of 2,5 hours should be reserved between the arrival time of the bus at the airport and the departure time of the flight. If the passenger has purchased tickets to two different travel operators they should reserve a minimum of 1,5 hours between the arrival of our bus and the connecting journey.

12.
In the interests of the safety and comfort of all of our customers, we restrict the size, type and quantity of luggage or other belongings which you can bring on to our buses and reserve the right to refuse permission for you to bring any item on to our service.

a) For every ticket purchased, you may take one piece of luggage up to 20 kg with you to be transported in the luggage compartment. The size of the luggage should not be larger than a normal size suitcase or backpack. Luggage that is significantly large in size or otherwise of special design or takes up a lot of space may not be accepted. The driver has the right to refuse a luggage which is not properly packed and is too large and/or too heavy to be accepted as luggage. The primary function of luggage is to protect its contents and it must be suitable for transport in the cargo space, eg. a suitcase, travel bag, backpack or bag that can withstand transport.

b) We accept folding bicycles in the hold provided that they are in its protective bag for additional charge.

c) You may also take one snowboard or one pair of ski on board for additional charge. A small folding pram can be accepted for carriage in the luggage compartment for additional charge.

If you travel with more luggage than this, your additional items may be refused if there is no available space. Frozen and fresh meat, poultry or fish, accumulators, explosives and combustible or otherwise hazardous materials including fireworks and petrol are not permitted on any our service. Only the driver may store or remove luggage from the hold of the bus or the ski box. We recommend that a name label is attached to each piece of luggage.

d) You may also take one small piece of hand luggage that must fit under your seat or in the overhead rack on board.

e) We cannot be held responsible for any loss or inconvenience to you if you are refused travel under these circumstances. We reserve the right to request that you open your bag for inspection by the driver or other company officer in your presence if, for reasons of security, it is considered necessary to do so.

f) Items that should never be placed in the luggage compartment include currency, valuable securities such as cheques, premium bonds or money orders, passports, driving licenses, certificates, jewelry, portable electronic devices such as cameras, mobile telephones, laptops and tablet computers, and other fragile or delicate items such as glass bottles, artwork as well as medicine and car and home keys. All items placed in the hold should be securely packed so that they can withstand normal handling and movement within the luggage compartment during the journey.

g) Please note that we cannot be held liable for the loss or damage of the items mentioned above. Valuables should be kept on your person or in your carry-on bags at all times.

h) We advise you to insure your personal belongings with a household or travel insurance, especially if carrying valuable items.

j) Carriage of dangerous good including fireworks, explosives, factory chemicals, ammunition of any kind is prohibited.

k) Carriage of live stock, raw material, goods for commercial purposes is not allowed.

13.
a) No Smoking policy; you are not permitted to smoke, this includes electronic cigarettes, in any of our buses. Our driver is entitled to require passengers to leave the bus if they do not comply with a request from the driver to stop smoking.

b) No Alcohol policy; you are not permitted to drink alcohol in any of our buses. Our driver is entitled to require passengers to leave the bus if they do not comply with a request from the driver to stop drinking.

14.
Dogs and other animals are not permitted on any Citybus Georgia bus, with the exception of assistance or emotional support dogs/cats. We recommend reserving a place for a guide in advance from our customer service.

15.
We have an insurance in accordance with our legal responsibility. All legal liabilities to third parties, to include damage to property and personal injury are covered. Our maximum liability to you for any loss or damage to your luggage, on Citybus Georgia  departures under any and all circumstances is limited. To find out these limits please contacts us.

We are not liable for loss or damage to hand luggage or valuable items unless caused by a traffic accident .Valuables include i.e. currency, valuable legal documents such as  bonds, payment orders (drafts), passports, driver’s licenses, reports/forms, jewelry, portable electronic devices such as cameras, mobile phones, portable/laptop computers, tablets and other fragile items, medication, and keys. The passenger is responsible for their hand luggage during the journey and should ensure that the luggage is placed in a safe place to protect the contents of the bag.

We recommend you insure your luggage, especially if you are carrying valuable items against all usual and normal risks of loss or damage to the full replacement value of the luggage, with no excess.

Loss or damage to your luggage or personal property must be notified immediately to your driver who will ask you to complete a form which you should complete and hand back to your driver or send to our customer service.

Due to operational and force majeure reasons and the use of coaches other than the one planned for the route we may not be able to offer all supplementary services. In these cases, we do not compensate the lack of bus feature services.

16.

Any tickets purchased via international distribution system  cannot be cancelled or amended. All tickets are non-refundable.

17. In case of force majeure situation such as vehicle En-Route break down or departure cancellation due to:

          -traffic conditions 

          -weather conditions

          -technical break-down

          -extensive delay from previouse rotation

          -governement imposed restrictions

we do our best to accomodate your trip as soon as possible. If our efforts will be deemed impossible to facilitate we will refund you with full amount of money paid on citybus.ge. 

If you bought your ticket via partner network or international distribution system., we will issue discount coupon code that cant be used for further bookings.

18. In case if it is required for operational reasons or reasons described at condition No 17 of this chapter, Company can change equipment without prior notice. Substitute equipment might not have all service amenities usually provided on our regular buses  and are subject of availability. In that case Company is not obligated to provide any compensation whatsoever for free services available on regular departures.

19. In case of mistake fares purchase ( tickets purchased with fare which is wrongly inserted to system/partner systems or produced due to wrong exchange rate or any kind of other mulfunction of distribusion systems or websites) we have right to cancel such ticket with full refund. In this case tickets cannot be used for travel, are void and null. Citybus Georgia LLC is not responsible for any mistake fares used while booking on other sites or via interbnational distribusion systems.

 

I.II Conditions of carriage for Partners Departures.

If your departure operated by subcontractor company or marketing partner, their respective conditions of carriage applied for that part of trip. Please be advised that these terms and conditions might be available on Georgian Language only.

2.

Departures operated by partners are clearly marked with sign “Operated By” during booking process.

3.

Citybus Georgia LLC  is acting as agent-distributor for such departures and not responsible for any damage or consequences caused by any circumstances related to these departures. Please check  terms and conditions for respective Partner’s web sites or offices.

II. Mobile Application Terms & Conditions

You must read these terms and conditions before you download and use the citybus.ge mobile application (“Mobile App”). By downloading and using the mobile application you agree to be bound by the terms and conditions set out below. If you do not wish to be bound by these terms and conditions you may not use the mobile application.

  1. General Provisions
    1. Pursuant to the Act on Provision of Electronic Communications Services (917/2014), the Service Provider establishes these terms and conditions for providing services electronically, hereinafter the “Terms & Conditions”.
    2. These Terms & Conditions set out the type and scope of Services provided electronically via the citybus.ge mobile application.
    3. Downloading the mobile application or using the Service mean that you accept the Terms & Conditions currently in force, and undertake to comply with them.
  2. Definitions included in the Terms & Conditions
    1. Mobile Ticket – an electronic ticket delivered to Mobile App authorizing the individual to travel between the bus stops specified thereon, within a specified term and for a specified fare;
    2. Personal Data – personal data of the Customer such as first name, last name, telephone number, post code of place of residence and e-mail address;
    3. Services – the services offered electronically by the Service Provider via the Mobile App and referred to in section 3 of these Terms & Conditions;
    4. Customer – any natural or legal person that has validly registered as a user of the Mobile App, also referred to as “you” in these Terms & Conditions;
    5. Service Provider – Citybus Georgia LLC, a company registered in Georgia with company ID 405470477;
    6. Mobile App – internet application created by the Service Provider that runs on smartphones and other mobile devices and is available for download at Apple App Store or Google Play under brand name GoCityBus and on which the Services are available after valid registration.
  3. Types and Scope of Services Provided
    1. Pursuant to these Terms & Conditions the Service Provider provides you with Services comprising of purchasing, delivering and storing mobile tickets via the Mobile App.
    2. Purchase process within the Mobile App consists of the following stages:
      1. selection of the journey (including departure and arrival cities, departure date and time, number of passengers and possible seat),
      2. acceptance of the Service Provider’s Terms & Conditions and Conditions of Carriage,
      3. payment via payment card,
      4. delivery of an mobile ticket to the Customer to the Mobile App.
      5. delivery of order confirmation via email to the email address specified in Mobile App.
    3. Payment for the mobile ticket may be made by a payment card only. Upon entering the payment card details in the Mobile App for the first time, the bank system may create a temporary charge to authorize the card; this charge will be automatically refunded. The payment card details are not saved in the Mobile App and the Service Provider does not save them in its own database. The payment card details are processed and stored only by the certified payment provider. The system of the Service Provider only saves tokens which are used to communication between the certified payment provider and the Service Provider. All payment information is secured with cryptographic protocols when sent over Internet so it cannot be read by in transit by a third party. The payment service is processed by  JSC TBC Bank Legal address: 7 Marjanishvili St., 0102 Tbilisi, Georgia ID Number: 204854595 
    4. Purchase of an mobile ticket on the Mobile App is final and non-refundable. m-Ticket can not be amended.
    5. An mobile ticket is delivered to Customer’s mobile device via the Mobile App. If your mobile device is lost or damaged, the reservation number in your confirmation email serves as a ticket. In case of problems, do contact Customer Service prior to the trip.
    6. In case of misuse, the Service Provider reserves the right to cancel the m-Ticket or to refuse your travel on the bus.
    7. The transport agreement between the Customer and the Service Provider shall be concluded upon delivery of an mobile ticket to the Customer via the Mobile App (as in section 3.b above).
    8. Inspection of the mobile ticket will take place via the Mobile App on board the bus in case of internet connection. Email confirmation is also accepted as ticket.
    9. You may ask questions and receive information with regard to the Mobile App through:
      1. the FAQ (frequently asked questions) internet page within www.citybus.ge,
      2. e-mail sent to a dedicated e-mail address: booking@citybus.ge; or
      3. dedicated helpline (tel. Number: +995 706 777 925) for more information.
  4. Use of Mobile App
    1. The Mobile App and all rights thereto are the sole property of the Service Provider. The Mobile App consists of content that is protected by copyright, trademark rights and/or other intellectual property rights.
    2. When using the Service to personal and non-commercial purpose, the Service Provider grants you a limited, non-exclusive, revocable and non-transferable license to use the Mobile App on a mobile device that is owned or controlled by you. You may not use the Mobile App or allow the Mobile App to be used for any other than for personal and non-commercial purpose.
    3. The mobile tickets made available by the Mobile App may be used only by the Customer with a valid registration. You agree to maintain accurate, complete and up-to-date information on your registered user profile. You are responsible for any activities taking place on your user profile. You agree to keep your username and password secure at all times. Your user profile is personal and you may not assign your profile to any third parties.
    4. You agree to comply with applicable law when using the Mobile App and agree that you are responsible for purchases made using your user profile. You agree that use of the Mobile App requires a connection to the internet. You will need to obtain the necessary connection and to pay for it yourself.
    5. The Mobile App is made available through on-line application stores, such as the Apple App Store (iOS version) and Google Play (Android version), and download may be subject to the terms and conditions thereof.
    6. You may cease using the Mobile App at any time. If you wish to unregister from your user profile, you may do so by removing information from your user profile and removing the Mobile App.  If you wish to have all your previous transactions erased, please contact us at privacy@citybus.ge
    7. On some devices, the Mobile App may take several seconds to load, so it is recommended that you load the Mobile App and the mobile ticket or confirmation email whilst waiting for the bus. Failure to show your m-Ticket or reservation to the driver or the ticket inspector when requested will result in you having to pay for a new ticket. It is your responsibility to ensure that the mobile device is sufficiently charged to display the m-Ticket as many times as required for the duration of your journey (both origin and destination stops).
  5. Liability of the Service Provider
    1. The Service Provider aims to keep the Service available to the Customer continuously and without interruption. However, the Service Provider cannot guarantee that the Service is available to the Customer uninterrupted, timely or error-free. The Mobile App, its operation or some features may be dependent on the compatibility of devices used, network connections, and content formats.
    2. The Service Provider reserves the right to modify or change the Mobile App or the Service, as well as to stop or shut down the Mobile App or the Service at any time, in whole or in part, without prior notice to users.
    3. The Service Provider is not responsible for any direct or indirect damages, unless caused through gross negligence or willful misconduct, resulting from the use of the Service or interruption thereof or these Terms & Conditions, even if the Service Provider has been advised of the possibility of such damages. In all cases, the Service Provider’s responsibility is limited to the m-Ticket price paid by the Customer. The above does not limit your rights as a consumer under mandatory legislation.
  6. Changes and Transfer of Responsibilities
    1. The Service Provider may change these Terms & Conditions at any time at its own discretion. Any change will take effect when notified of in the Mobile App or via email. You shall be deemed to have accepted the amended Terms & Conditions if you continue to use the Service after the notification.
    2. You may not assign or transfer your rights and/or obligations under the Terms & Conditions. The Service Provider may transfer its rights and obligations under these Terms & Conditions to any third party without your consent.
  7. Complaint Procedures
    1. The Customer may file a complaint when Services provided by the Service Provider are provided contrary to these Terms & Conditions:
    2. in writing, or
    3. by email to: privacy@citybus.ge.
    4. A complaint should contain a description of the problem giving grounds for the complaint and to indicate the Customer’s information.
    5. The complaint should be sent no later than 21 days after the completed journey. The Service Provider shall inform the Customer of the results of the complaint by letter or email to the address given by the Customer no later than 21 days after it has arrived.
  8. Data Protection
    1. The Service Provider is the data controller within the meaning of the General Data Protection Regulation (2016/679/EU). The controller of your Personal Data is Citybus Georgia LLC. Your personal data is collected for the preparation and implementation of the contract for the sale of tickets, as well as for electronic direct marketing for same kinds of services offered by the controller. Your personal data cannot be used by the controller or third parties for other types of electronic direct marketing purposes unless you give consent to such marketing. The collected data can only be provided to entities specified in law or to third parties as set forth in  Privacy Policy. You have the right to access your data and to exercise your other data subject rights specified in the General Data Protection Regulation and in Citybus Georgia’s Privacy Policy. Processing of your personal data is necessary for the performance of a contract between the Service Provider and you.
    2. The Service Provider processes the Personal Data included in the Mobile App in accordance with the General Data Protection Regulation and other applicable legal provisions. The Service Provider may process your Personal Data also without your consent, if such processing is necessary for the performance of a contract, for the compliance with a legal obligation, or for the purposes of legitimate interests pursued by the Service Provider or a third party, as further specified in the Privacy Policy. The Service Provider shall keep the Personal Data confidential and not disclose it to any other entities, unless the Customer clearly authorizes the Service Provider to do so, or such an authorization results from legal provisions or is specified in the Privacy Policy. This obligation remains in force after the legal relationship between the Customer and the Service Provider ends.
    3. The Service Provider may use the Customer’s Personal Data for marketing purposes, particularly to send the Customer commercial information originating from the Service Provider or third parties by e-mail only when the Customer has given his/her consent to such use by marking the appropriate box on in the Mobile App. The Customer always has the right to withdraw such consent, and may do so by following the procedure set forth in the Privacy Policy. The Service Provider may use the data received from purchased tickets to target the Customer with third party marketing. Such electronic marketing is based on the Customer’s consent, collected before providing the Personal Data to the Service Provider.
    4. For more information regarding the Service Provider’s processing of your Personal Data, please see the Privacy Policy on the website.
  9. Terms of use of the content of Mobile App
    1. rights to the content of the Mobile App, including the right to the texts, graphics, layout, data bases or other elements are reserved unless expressly stated otherwise. Using the content placed on the Mobile App does not mean acquiring by the Customers or other users of the Mobile App any intellectual property rights to works or data bases included in the Mobile App. The Customer or other users of the Mobile App may use these works or data bases only to the extent necessary to use the Service provided under these Terms & Conditions. In particular, it is forbidden, for commercial purposes, without the prior written consent of the Service Provider: to copy, to modify or transmit electronically or otherwise any part of the Mobile App in its entirety or any fragment thereof, or to extract or re-use substantial (as to quality or quantity) parts of content of data bases placed on the Mobile App, including use of any automatic systems or software extracting the Mobile App data (“screen scraping”, “web scraping” or “web Indexing”). The Service Provider reserves the right to block access to the Mobile App to individuals or entities who infringe the above terms of use.

III. Onboard WI -FI Terms & Conditions

You must read these terms and conditions before you access and use the Wi-Fi service. By accessing and using the Wi-Fi service you agree to be bound by the terms and conditions set out below. If you do not wish to be bound by these terms and conditions you may not access or use the Wi-Fi service.

  1. These terms and conditions define the principles and scope of using the Wi-Fi access point (the “Service”) made available for Users by Citybus Georgia LLC (the “Operator”).
  2. After accepting the above terms and conditions, the User will be directed to the website www.citybus.ge/wifi enabling unrestricted access to the Service. After entering this website, terms and conditions and cookie policy of citybus.ge website apply.
  3. The Service is free of charge.
  4. The Service is only available within Georgia
  5. The Operator shall not be liable whatsoever for:
    1. temporary lack of access to the Service or low connection bandwidth;
    2. unauthorized use of software or other works available on the Internet and being subject to intellectual protection,
    3. damage caused by third party software,
    4. technical conditions online radio and Internet zone delays that might affect the actual Internet transfer to and from the User’s computer.
  6. The Operator does not provide any support to network users, nor is the Operator responsible for compatibility of the User’s equipment with the access point infrastructure.
  7. Due to safety reasons, access to all network services is not guaranteed.
  8. The radio transmission of the Service is not encrypted.
  9. The Service is used solely at the User’s own risk.
  10. The User must not use the Service for the following purposes:
    1. transmission and provision of access to content that are not within the law or is subject to protection of intellectual property to which the User is not entitled,
    2. transmission and provision of access to content that might violate somebody’s personal rights,
    3. mass distribution of advertising content not being ordered by recipients (spam),
    4. distribution of computer viruses and other software that might damage computers of other Internet users,
    5. reselling access to the Internet network without Operator’s knowledge and written consent,
    6. considerable load put on the band by way of making available WWW, IRC, NNTP, etc. servers.
  11. If the User does not observe the provisions of these terms and conditions or uses the Service in contravention of its purpose, the Operator will be entitled to block access to the Service or limit the connection bandwidth.
  12. The User is solely liable for the manner of his/her usage of the Service, including for the content of messages sent.
  13. The User shall be solely liable for the consequences of using the Service and for the User making available the User’s passwords/access codes/login/other data to third parties.
  14. The User is not entitled to any claims for temporary or permanent loss of Internet signal or for limitation of the connection throughput arising from the transmitter being turned off or the transmitter suffering technical problems.
  15. In order for the Service to be provided, the Operator may use “cookie” files that may be saved on the User’s computer. Such files can also be read each time this computer is used for connection. Cookies provide statistical data on users’ traffic and use of particular websites and, thus, enable efficient provision of the Service. The User can at any time turn off the option of accepting cookies in his/her browser, however this may hinder or prevent use of the Service.
  16. The Operator undertakes to make every effort to protect the account User’s personal data. The Operator undertakes to keep the data confidential and not to disclose it to other entities unless the User expressly authorizes the Operator to do so or unless such authorization arises from the law. This obligation will remain in effect after all legal relationships between the User and the Operator expire.
  17. Personal data is collected only for marketing and statistical purposes. By accepting these terms and conditions, the User gives consent to such data being processed in the scope indicated herein. The data collected may be made available only to entities indicated in legal regulations.  Personal data is provided by the User voluntarily.
  18. The Operator is not responsible for privacy protection strategies of other websites.
  19. The Operator reserves the right to introduce changes to these terms and conditions. The User is not entitled to any claims due to this reason.
  20. In any matters not governed by this agreement, the provisions of Georgian Law shall apply.
